Group to sue Publix developer - al.com: "Claiming that muddy runoff from a Publix Super Market construction site in Fairhope is rapidly choking the ecosystem, the Fly Creek Preservation Association announced Tuesday its intention to sue the project's developer, contractors, engineers and others in federal court in Mobile.

Jackie Wavrunek of the preservation group said Tuesday that silt fences and retention ponds have failed repeatedly, causing tons of mud to pile up more than a foot high in the neighboring creek bed and wetlands on Fairhope's north side."
